Official Rules

PRELIMINARY INFORMATION

NO PURCHASE NECESSARY. A purchase will not improve your chances of winning. Void where prohibited. The Tervis Mystery Offer ("Promotion") will begin on November 29 at 12:01 AM ET and end on December 18 at 11:59 PM ET ("Promotion Period"). All times in the promotion refer to Eastern Time ("ET"). Promotion is subject to all applicable federal, state and local laws.

ELIGIBILITY

Open only to permanent, legal United States ("U.S.") residents who are at least eighteen (18) years of age or older as of the start of the Promotion Period. By entering this Promotion, you warrant and represent that you are at least eighteen (18) years old; that you or your immediate family members do not work for Tervis; that you legally reside and physically live in the U.S.; that your entry is being submitted as your own original work or pursuant to lawful consent. If there is a dispute as to who owns a winning entry, the presumed winner will be determined by Tervis in its sole and absolute discretion.

To participate in the Promotion for a chance to win Tervis merchandise, eligible person must visit a Tervis store or Tervis.com to spin the wheel (an "Entry").

DRAWING PROCEDURE

Online prizes will be selected at random. In-store winners will be selected at random based on a wheel spin. The odds of winning a prize depend on the total number of eligible entries received.

LIMITATIONS

Product and electronic discount coupon prizes valid only in Tervis stores and Tervis.com between 11/29/2018-12/18/2018, while supplies last. This offer may not be applied to previous purchases or combined with any other offers or discounts. Excludes third party branded items. Not valid on wholesale or corporate orders. You agree that Tervis, including but not limited to its officers, directors, agents, employees or agencies (collectively the "Released Parties"), are not responsible for and shall not be liable for: (i) any act, failure to act, delay, or error relating to the transmitting or processing of Entries; (ii) telecommunications network, phone system, computer system, hardware, or software malfunctions, failure, disconnection, data loss, or other difficulties of any kind, including any injury or damage to any Entrant's computer resulting from participating in the Promotion; (iii) any incorrect or inaccurate information, whether caused by your own printing errors or by any of the equipment, hardware, software or programming associated or used with Promotion; (iv) any conditions caused by events beyond the control of the Released Parties that may cause Promotion to be disrupted or corrupted; (v) any losses or damages of any kind resulting directly or indirectly from acceptance, use, or misuse of any prize awarded in Promotion or from participation in Promotion; or (vi) any printing or typographical errors in any materials relating to Promotion. Entrants/winners are solely responsible for compliance with all applicable laws, rules and regulations including but not limited to tax and similar reporting obligations imposed by federal, state and local authorities. Tervis reserves the right, in its sole discretion, to cancel, modify, terminate, or suspend this Promotion without notice if causes beyond Sponsor's control corrupt the administration, security, or operation of Promotion.

HOLD HARMLESS

By participating in Promotion, to the extent permitted by law, you release and hold harmless the Released Parties from any and all damages, injuries, claims, causes of action, or losses of any kind resulting from participation in Promotion, or the acceptance, possession, use, or misuse of any prize, including without limitation, personal injury, death, property damage, defamation, infringement of intellectual property rights, and claims based on the rights of publicity and privacy.

WINNER NOTIFICATION

Tervis store winners will be revealed instantly upon spinning the wheel. Tervis.com winners will be revealed instantly upon clicking a digital offer reveal. Each entry, mail-in and digital, will receive a prize or discount. The prizes and discounts are not redeemable for cash and may not be transferred or substituted. Each discount or prize is valid for one time use and must be redeemed during the Promotion Period, 11/29/2018-12/18/2018. If by reason of a printing or other error, more prizes are claimed than the number set forth in these official rules, all Entrants making purportedly valid claims will be included in a random drawing to award the advertised number of prizes available in the prize category in question. No more than the advertised number of prizes will be awarded.

By entering this Promotion and/or accepting any prize you may win, you agree that Tervis' decisions will be final and binding on all matters related to this Promotion; Tervis may use your name and state of residence online and in print, or in any other media, in connection with this Promotion without payment or compensation to you, except where prohibited by law; this Promotion will be governed by the laws of the State of Florida, and you consent to the exclusive jurisdiction and venue of Florida courts (state and federal) for any disputes arising out of this Promotion, You further understand that if someone cheats, or a virus, bug, catastrophic event, or any other unforeseen or unexpected event that cannot be reasonably anticipated or controlled, (also referred to as force majeure) affects the fairness and /or integrity of this promotion, Tervis reserves the right to cancel, change or suspend this promotion. This right is reserved whether the event is due to human or technical error. If a solution cannot be found to restore the integrity of promotion, Tervis reserves the right to select a winner from among all eligible Entries received before Tervis had to cancel, change or suspend Promotion. You acknowledge that computer "hacking" is a crime and that if you attempt to compromise the integrity or the legitimate operation of this Promotion by hacking or by cheating or committing fraud in any way; Tervis may seek damages from you to the fullest extent permitted by law
